Matthew C. Reagan

Associate Attorney

Matt Reagan is a senior associate in the San Francisco office of Gibson, Dunn & Crutcher, where he practices in the firm’s Litigation Department. Matthew’s practice focuses on technology, media, and intellectual property law. He represents technology and media companies in all phases of litigation, including trial and appeal, and he counsels them on data privacy and technology-related risks.

Matt previously clerked for the Honorable Eric D. Miller of the United States Court of Appeals for the Ninth Circuit.

Representative matters include:

  • Member of the trial team that won a complete defense verdict in a trademark infringement matter on behalf of a major video platform, in the company’s first trial in the United States.
  • Member of the trial team that successfully represented a major computing company in a three-week jury trial against claims of copyright infringement and tortious interference brought by Oracle in a lawsuit relating to an Oracle operating system. Previously achieved summary judgment in part, on statute of limitations grounds, which the Ninth Circuit affirmed on appeal.
  • Secured summary judgment victory on willfulness damages, for a leading digital download service provider, in multiple copyright infringement litigations related to musical compositions.
  • Won dismissal of breach of fiduciary duty and related claims on behalf of a major television studio, leading to a favorable settlement in litigation brought by a production company.
  • Represented media company in copyright infringement cases posing novel questions about the “public display” right, one case of which settled on the eve of trial.
  • Represented a large social media company in multijurisdictional data privacy, securities, and derivative litigation.
  • Represented telecommunications and media company in its successful defense of the Department of Justice’s challenge to a proposed merger.
  • Won dismissal of a foreign judgment enforcement action after taking over for a separate firm that had unsuccessfully sought dismissal.
  • Counseled major technology companies on issues related to federal and state privacy laws, the CFAA, the ECPA, the FTC Act, and competition law in connection with product development.
  • Matt also values pro bono work. Among other matters, he previously:
  • Won immigration relief for a married couple after eight years in removal proceedings, which included securing the expungement of a 30-year-old criminal felony conviction. The Government folded its case on the eve of the merits hearing and stipulated to relief.
  • Received the Animal Legal Defense Fund’s Advancement in Animal Law Pro Bono Achievement Award for successfully representing a nonprofit in civil litigation against an organization that had abused horses.
  • Filed amicus briefs on constitutional issues in the Ninth Circuit and appellate merits briefs in state courts of appeal.

Matt earned his law degree, Order of the Coif, from the University of California, Berkeley School of Law, where he served as the director of the McBaine Honors Moot Court Competition, as an editor for the Berkeley Technology Law Journal, and as a judicial extern for the Honorable Jon S. Tigar of the United States District Court for the Northern District of California.

Matt earned his undergraduate degree from the University of Southern California. Before law school, he worked in the mobile and social games division of a prominent video game company and interned at several major record labels. He also previously interned in the legal department of a mobile gaming company.

Matt is admitted to practice law in the State of California and is a member of the bars of the United States Court of Appeals for the Ninth Circuit and the United States District Courts for the Northern District of California and Central District of California. He is a Certified Information Privacy Professional (CIPP/US), as recognized by the International Association of Privacy Professionals (IAPP).
