Alexandra Perloff-Giles

Alexandra Perloff-Giles is an associate in the New York office of Gibson, Dunn & Crutcher. She is a member of the firm’s Media, Entertainment, and Technology, Appellate and Constitutional Law, and Litigation Practice Groups.

Alexandra has litigated a broad range of high-stakes commercial disputes, at both the trial and appellate levels, and has argued in both state and federal courts. In addition, she has significant experience with copyright, trademark, First Amendment, and other art, media, and entertainment-related matters and has been recognized by Best Lawyers: Ones to Watch® in America for Entertainment and Sports Law (2024-2025).

Representative matters include:

Complex Commercial Litigation:

• Successfully represented ad hoc group of lenders in breach of contract and implied covenant of good faith and fair dealing lawsuit, culminating in a full victory after a week-long bench trial in federal court. Conducted direct examination of key witness.
• Represented a leading satellite company in a two-week bench trial on breach of contract and unjust enrichment claims.
• Represented sports betting company and its board of directors in breach of fiduciary duty litigation. Obtained full dismissal upon appeal to First Department Appellate Division.
• Represented a major news magazine in New York state court appeals relating to efforts to recover damages caused by prior owner’s mismanagement.
• Represented major law firm in dispute with former partner. Obtained affirmance of order compelling arbitration on appeal.
• Secured early dismissal of tort claims against major French agricultural company.

Media and Entertainment:

• Represented Mary Trump in litigation brought by Donald Trump in connection with Ms. Trump’s publication of her book, Too Much and Never Enough, and provision of documents to The New York Times.
• Represented creators of unscripted television show in copyright and trademark litigation.
• Obtained dismissal of lawsuit brought against Bob Dylan which involved alleged breach of 1975 work-for-hire agreement. Secured affirmance in the First Department Appellate Division.
• Obtained dismissal of defamation lawsuit against television network brought by prominent former news host.
• Represented New York Times in successful legal challenge to Justice Department efforts to obtain email logs for Times journalists, culminating in significant revisions to Justice Department policy on obtaining information from or records of members of the news media.
• Represented prominent journalist in dispute with former employer. Secured favorable settlement.
• Represented free-lance journalist in motion to quash subpoena.
• Represented CNN White House correspondent Jim Acosta and Playboy White House correspondent Brian Karem in successful litigation against President Donald Trump and other officials over the suspension of Mr. Acosta and Mr. Karem’s White House press passes.

Alexandra also maintains an active pro bono practice. She has won asylum for numerous clients in both affirmative and defensive proceedings, successfully challenged a Trump administration rule that would have dramatically increased fees for certain immigration proceedings, and argued appeals of asylum and Convention Against Torture cases in the Ninth Circuit and Second Circuit. She has also authored amicus briefs filed in the Supreme Court and federal circuit courts on issues relating to immigration, First Amendment, and government surveillance. In 2023, she was honored with Sanctuary for Families’ 2023 Above & Beyond Pro Bono Achievement Award.

Alexandra graduated magna cum laude and Phi Beta Kappa from Harvard College, earned a Master’s from the Université de Paris—Sorbonne, and received her Juris Doctor from Yale Law School, where she was executive editor of the Yale Law Journal and managing editor of the Yale Journal of Law & Technology. After law school, Alexandra served as a law clerk for the Honorable Marsha S. Berzon of the U.S. Court of Appeals for the Ninth Circuit.

In 2019-2020, Alexandra served as the First Amendment Fellow at The New York Times, where she litigated freedom of information, libel, and First Amendment cases on behalf of The Times, counseled reporters and editors on copyright and newsgathering issues, and provided prepublication review. Notable achievements include obtaining data on millions of coronavirus cases through a federal FOIA suit against the CDC; defeating a Glomar response by the CIA in a case seeking the Trump Administration’s rules governing the use of lethal force abroad; and arguing before the Second Circuit in a successful bid to permit the publication of law enforcement personnel records obtained following the repeal of New York Civil Rights Law 50-a. From 2020-2022, Alexandra served on the Freedom of Information Act Federal Advisory Committee, a position to which she was appointed by the Archivist of the United States. Alexandra currently teaches a seminar on Law & the Arts at Columbia University.

Alexandra is admitted to practice in the State of New York, as well as before the United States Courts of Appeal for the Second Circuit, the Fifth Circuit, and the Ninth Circuit and the United States District Courts for the Southern and Eastern Districts of New York.
