PRACTICE

Litigation Administrative Law and Regulatory Practice Crisis Management Intellectual Property Real Estate

BIOGRAPHY

Paul J. Kremer is Of Counsel in the New York office of Gibson, Dunn & Crutcher.  He is a member of Gibson Dunn’s Litigation, Intellectual Property, and Crisis Management Practice Groups, where he focuses on contract, lease, and license disputes; patent infringement cases; and state and local regulatory challenges.

Mr. Kremer represents a diverse array of clients engaged in high-stakes commercial litigation, from New York City park trustees and private real estate developers to Fortune 100 technology companies and prestige television networks.  His intellectual property clients run the gamut, from garage startups to world-renowned pharmaceutical and consumer electronics makers.  He also has extensive experience helping clients of all types navigate the New York State and New York City regulatory spheres.

Mr. Kremer is equally comfortable representing large and small clients in bet-the-company litigation.  Since 2014, he has coordinated the defenses of the coal-fired power plant industry’s most successful mercury abatement companies, in a series of nine-figure patent infringement actions brought by various competitors.  He has also defended a startup fine-art brokerage falsely accused of misappropriating client lists, prevailing at oral argument to defeat a preliminary injunction motion and subsequently winning a sanctions award on behalf of his client.  In 2019, he was instrumental in defending against Article 78 challenges seeking to halt construction of the New York Islanders’ privately financed arena project.  Mr. Kremer also has expertise in commercial real estate and construction disputes, having represented landlords, tenants, and developers in a variety of disputes in New York court.

In addition to his deep experience in defense-side work, Mr. Kremer regularly represents plaintiffs in both Article 78 proceedings and commercial disputes.  He helped lead challenges to the New York City Department of Sanitation’s ban on recyclable foam food-service packaging, as well as a challenge to the New York City Taxi & Limousine Commission’s rules requiring retrofits for ride-share vehicles.

Mr. Kremer’s pro bono litigation work focuses on prisoners’ rights cases, police misconduct, and trans rights.  Since 2020, he has served on the board of directors of New York Disaster Interfaith Services (NYDIS), a network of faith-based disaster response providers.  Mr. Kremer has also served as Gibson Dunn’s liaison to the Transgender Legal Defense & Education Fund (TLDEF).

Since 2018, Mr. Kremer has served as a member of the firm’s Hiring Committee.  He is a first-generation professional and an inaugural member of the firm’s First Generation Professionals affinity group.

Mr. Kremer earned his Juris Doctor from Harvard Law School.  As a law student, he served as a special Assistant District Attorney for the Suffolk County District Attorney’s Office in Boston, Massachusetts.  Previously, he interned at the United States Attorney’s Office for the Eastern District of New York in Central Islip, New York.  Mr. Kremer received his Bachelor of Arts degree in Economics and Political Science from Loyola University (Maryland), where he graduated summa cum laude and was elected to Phi Beta Kappa.

Mr. Kremer is admitted to practice in the State of New York and before the United States District Courts for the Southern and Eastern Districts of New York, the Western District of Wisconsin, and the Eastern District of Texas, as well as the Federal Circuit Court of Appeals.
